These Terms of Use (the “EULA”) apply to the version of Boomkey obtained through the Mac App Store. For the version downloaded directly from our website, see our main Terms of Use.

About

Boomkey is a product of Poteam (the “Developer”), registered in Ukraine. For support, email [email protected].

Acknowledgement

This EULA is concluded between you and the Developer only, and not with Apple. The Developer, not Apple, is solely responsible for the Application and its content. This EULA does not provide for usage rules for the Application that conflict with the Apple Media Services Terms and Conditions as of the effective date of this EULA. The Developer acknowledges that it, and not Apple, is responsible for addressing any claims relating to the Application or your possession and/or use of it.

The Application

Boomkey is a macOS utility that automatically corrects text typed in the wrong keyboard layout. The Application is distributed through the Mac App Store and runs on Apple-branded devices that you own or control.

Scope of License

The Developer grants you a non-transferable license to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where enabled. This license does not allow you to use the Application on any device that you do not own or control, and you may not distribute or make the Application available over a network where it could be used by multiple devices at the same time.

Purchases and Pricing

The Application is sold and distributed by Apple through the Mac App Store. Any purchase price, in-app purchases, or free trial terms are shown on the App Store listing and are processed by Apple, which acts as the seller of record. Apple handles all payment processing, billing, invoicing, and the collection and remittance of applicable taxes. Purchases are also subject to the Apple Media Services Terms and Conditions.

Refunds

Because the Application is sold by Apple, refunds for App Store purchases are handled by Apple, not by the Developer. To request a refund, use Apple's “Report a Problem” page (reportaproblem.apple.com) or contact Apple Support. We are not able to issue refunds for App Store purchases directly.

Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for the Application, as specified in this EULA or as required under applicable law. You can reach us at [email protected]. The Developer and you acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

Updates

The Application is updated through the Mac App Store. Installing updates is at your option through your App Store settings.

Warranty

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The Application is provided “as is” and “as available” without warranty of any kind, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer's sole responsibility. Text corrections are performed on a best-effort basis using language detection heuristics, and we do not warrant that they will be accurate in every case.

Product Claims

The Developer and you acknowledge that the Developer, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Application's use of any data.

Intellectual Property Rights

The Application, including its code, design, and dictionaries, is owned by the Developer and protected by copyright and other intellectual property laws. All rights not expressly granted in this EULA are reserved. In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Restrictions

You may not:

  • Reverse engineer, decompile, or disassemble the Application, except to the extent that applicable law expressly permits
  • Redistribute, resell, sublicense, rent, or lease the Application
  • Use the Application for any unlawful purpose or in violation of this EULA or the Apple Media Services Terms and Conditions

Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Limitation of Liability

To the maximum extent permitted by law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or in connection with your use of the Application. Nothing in this EULA limits any non-waivable rights you have under applicable consumer protection laws in your country of residence.

Third-Party Beneficiary

The Developer and you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

Governing Law

This EULA is governed by the laws of Ukraine, with consumer rights of EU/UK buyers preserved under their local law. Nothing in this EULA limits any non-waivable rights you have under applicable consumer protection laws in your country of residence.

Changes to This EULA

We may update this EULA from time to time. Material changes will be posted on this page with a revised “Last updated” date.
